How to Avoid GST Notices: 12 Red Flags the GST System Catches, and How to Stop Each One

GST नोटिस से कैसे बचें: 12 रेड फ्लैग और BUSY में हर महीने 30 मिनट की जाँच

GST notices now come from data matching. The 12 mismatches that trigger most of them (GSTR-1 vs 3B, 3B vs 2B, e-way bills, ITR turnover, Rule 37, 16(4)) and a 30-minute monthly check in BUSY.

Very few GST notices start with an officer opening your file. Most start with a computer comparing two numbers that should be equal: your GSTR-1 with your GSTR-3B, your ITC with GSTR-2B, your e-way bills with your sales, your GST turnover with your income-tax return. When they differ, an intimation or scrutiny notice follows, sometimes two or three years later, with interest.

So avoiding notices is not luck. It is finding the same differences before the department does, every month, while they are small and easy to explain. Below are the 12 red flags behind most notices we see at our BUSY clients, and a 30-minute check that catches them. (For forms, late fee and penalty, read our main guide on GST notices, scrutiny and penalty.)

The 12 red flags

#Red flag (what the system compares)Usual causeHow to stop it
1Tax in GSTR-1 more than tax paid in GSTR-3BSales added after GSTR-1, or 3B edited by handFile GSTR-1 complete and on time; correct missed sales through GSTR-1A before 3B, not by changing 3B
2ITC in GSTR-3B more than ITC in GSTR-2BBills claimed before the supplier uploaded them, or claimed twiceClaim only what GSTR-2B shows; keep the rest pending till it appears
3E-way bills more than sales in GSTR-1E-way bill not cancelled when goods did not move, or bill not reportedCancel unused e-way bills within 24 hours; match e-way bills with the sales register monthly
4E-invoices (IRN) not matching GSTR-1E-invoice cancelled or changed in BUSY but not on the portalNever edit an e-invoiced bill; cancel within 24 hours or issue a credit note
5ITC from a supplier whose GSTIN is cancelled or who does not fileNo check on new suppliersCheck GSTIN status and filing before the first purchase (GSTIN checker)
6ITC claimed after the time limit (section 16(4))Old bills found at year-end or during auditClaim previous year's ITC by 30 November of the next year (or the annual return date, if earlier)
7Supplier not paid within 180 days, ITC not reversed (Rule 37)Old creditors ignoredList bills older than 180 days every month; reverse ITC and re-claim on payment
8Blocked ITC taken (section 17(5))Car, food, gifts, building work booked as normal purchaseKeep separate ledgers for blocked items; do not claim them
9RCM not paid in cash, or RCM credit taken without paymentLegal fee, GTA, rent from unregistered person missedBook RCM every month and pay it in cash in 3B (RCM in BUSY)
10Supplier's credit note not reflected by youDiscount credit notes not entered in booksEnter every credit note received; reduce ITC in the month it appears
11GST turnover different from income-tax return / AIS / TDS dataOther income, stock transfers, exempt sales or year-end entries treated differentlyBefore ITR and GSTR-9, reconcile turnover in books, GSTR-1, GSTR-9 and the ITR; keep the working
12Late payment interest not paid3B filed late, interest left outPay interest with 3B; use the interest calculator and check the interest shown in the next 3B

Limits, dates and forms are notified by the government and change from time to time. Always check the latest advisory on the GST portal or with your CA.

The 30-minute monthly check

Do this every month after sales and purchases are entered and before GSTR-3B is filed. Quarterly (QRMP) filers do it before the quarterly return.

  1. Day 1-10: enter every bill

Sales, purchases, credit and debit notes, RCM and expenses, in the correct month. Bills entered late are the root of red flags 1, 2 and 10. For long supplier bills, import them from the e-invoice instead of typing.

  2. Before GSTR-1: sales side (10 min)

Match the BUSY sales register with e-way bills and e-invoices of the month. Check customer GSTIN, state and HSN. File GSTR-1 from BUSY (steps).

  3. Before the 14th: IMS

Open the Invoice Management System and accept, reject or keep pending each supplier bill, so GSTR-2B is right. The IMS offline (Excel) tool helps when the list is long.

  4. Purchase side (10 min)

Compare purchases in BUSY with GSTR-2B: bills in 2B but not in books (enter them), bills in books but not in 2B (keep ITC pending, call the supplier). Check suppliers' GSTIN status.

  5. Before GSTR-3B: tax side (10 min)

Tax in 3B = tax in GSTR-1 = tax in books. ITC in 3B = eligible ITC in 2B, minus blocked credit, minus Rule 37 reversals. RCM paid in cash. Interest included if late. See the GSTR-1 / 3B checklist.

  6. Save the proof

Keep the month's returns, challans, 2B, reconciliation and a short note of differences in one folder. If a notice comes years later, your reply is already written.

Notice-proof habits for the year

  • Quarterly: confirm balances with big customers and suppliers (balance confirmation in BUSY) and list creditors older than 180 days.
  • September-November: claim any missed ITC of last year before the section 16(4) deadline, and clean up last year's differences in GSTR-1A / 3B.
  • Before GSTR-9 and the ITR: reconcile turnover and ITC for the whole year; the same numbers should appear in books, GSTR-1, GSTR-3B, GSTR-9 and the ITR, or the difference should be explained on paper.
  • Every notice: reply in time, even to ask for time. A missed reply turns a small mismatch into a demand. See how to reply to a GST notice.

How BUSY and Bharat GST Champ help

BUSY prepares GSTR-1 and GSTR-3B from your vouchers, so when every bill is in BUSY the returns agree with the books. Bharat GST Champ, our BUSY add-on, does the matching part inside BUSY: GSTR-2A / 2B and GSTR-1 compared with your books bill by bill, missing bills shown in red, and received e-invoices posted item-wise so purchase bills match the supplier's data exactly. Bharat Darpan matches party ledgers. Both have a free demo.

FAQ

What is the most common reason for a GST notice?

A mismatch between two returns: tax in GSTR-1 more than tax paid in GSTR-3B, or ITC in GSTR-3B more than GSTR-2B. Both are caught automatically and lead to DRC-01B or DRC-01C intimations or ASMT-10 scrutiny.

Can I get a GST notice even if my returns are filed on time?

Yes. Filing on time avoids late fee, but notices come from differences in the data: e-way bills vs sales, ITC vs GSTR-2B, GST turnover vs the income-tax return, or ITC from a supplier whose registration was cancelled.

How often should I reconcile to avoid GST notices?

Every month, before filing GSTR-3B: sales with e-way bills and e-invoices, purchases with GSTR-2B, and tax in 3B with GSTR-1 and the books. Add a full-year check before GSTR-9 and the ITR.

Does the department compare GST with the income-tax return?

Yes, turnover and other data are shared between tax departments. Keep a reconciliation of turnover in books, GST returns and the ITR so any difference can be explained.

What is the last date to claim missed ITC?

Under section 16(4), ITC of a financial year can be claimed till 30 November of the next year or the date of filing the annual return, whichever is earlier. Check for any later change in law.
